Canadian Commercial Law Research Paper

Question Description

Overview

This final assessment is worth a total of 100 marks and accounts for 40% of your final grade.

Purpose

The final assessment gives you the opportunity to demonstrate your ability to apply research skills by identifying items around you with the laws that govern them.

Introduction

With the mass availability of cell phone cameras and sites like Facebook, Instagram, and Pinterest, the world is now flooded with people taking photographs of their daily experiences.

Many times, people will comment on their own (and others ) photographs on social media. It has also become a popular way for individuals to speak directly to businesses.

You may also have heard the expression a picture tells a thousand words.

Taking and posting a picture (and accompanying commentary) on social media should require a good deal of thought What do I include in the picture? What do I exclude? How do I frame the picture? Why? Do I edit the picture? How? Why? What response do I want my picture to generate? Who do I want to see my picture? Are there any risks with posting this picture? Social? Legal?

Business owners go through similar processes with respect to their business every day from deciding what new products to launch, to who to hire, to how much to charge, to where to spend their advertising dollars, to how to respond to customer praise and complaints. Every act must be carefully thought through.

Since you are likely stuck at home at the moment, take a look around where you live. Look out the window and think about all the things that you can see that would not be there if it was not for a business. What are some of the decisions and issues that must have gone into making it so that everything is the way it is at the moment, so that you can see what you currently see? Were those good decisions or bad decisions? Did you buy something because of a successful advertising campaign, or did you feel deceived? How many contracts do you see around you at the moment? How many potential torts? How many contracts or potential torts do you see on the news?

This final assessment is intended to provide you with an opportunity to show your understanding and application of the material we have covered in the course in a creative way.

Instructions

  1. Take four photographs of things around you in your home that are there because of business laws. We have covered a lot of different areas in this course; therefore, each photograph must deal with a different topic from the course.
  2. Write a commentary for each photograph outlining your reasons for choosing your photograph and what makes it interesting. What triggered the connection between your picture and the law? Is the connection obvious or subtle? Did it affect the way you view the law? These are just a few of the questions for you to consider.
  3. Finally, identify the specific statute(s) that applies/apply to the object of your commentary. Provide a legal citation for the law that you have chosen. If you know the specific part or section of the legislation, include it in your citation. If you think common law applies, rather than statute, define the legal principle involved. Include a citation from one reported case in CanLII that discusses your topic.

For each photograph, a maximum of 20 marks will be available for the photograph and accompanying commentary. Being creative, and making me think or laugh, will definitely help you!

5 marks per photograph will be available for identifying the specific statute that applies to it, or a case that considers it.

The assignment should be no more than 2000 words in total (so each picture doesn t really say 1000 words!). Please submit one document with your complete answer.

Submit the finished assessment in below.
